CCG’s healthcare investigators secured testimony from patients who attested to the doctor's professional conduct, served subpoenas, conducted a thorough review of medical records, and prepared expert testimony on opioid diversion and compliance with opioid and DEA regulations.

The Trial of Dr. Thomas Sachy

The trial commenced in May 2023 in the Middle District of Georgia. The prosecution started strong, using emotional testimony from the family members of the deceased. However, they encountered significant issues during the technical portions of their case, particularly during the cross-examination of their expert anesthesiologist, Dr. Barry Straus.

Our meticulous analysis and preparation aided the defense team, led by attorneys Ronald W. Chapman II and Meggan Sullivan, in discrediting the prosecution's expert forensic toxicologist, Stacy Hail. The missteps in her testimony about opioids leading to death, and the subsequent error about medication bottles found near a deceased patient, were pivotal points in the case.

These objections by the defense eventually resulted in the dismissal of charges related to the deaths of the two patients. The government was forced to admit that they lacked foundational toxicology evidence to support the charges, leading them to rest their case prematurely. This was a significant victory in the case, and it demonstrated the importance of a thorough and well-executed defense strategy.

Still facing charges of running a drug-involved premises, engaging in a conspiracy to unlawfully distribute, and unlawfully prescribing to three specific patients, the defense, backed by our comprehensive investigation, called on 10 witnesses. These included former patients of Dr. Sachy, family members of deceased patients, and an addictionologist who evaluated pain patients for Dr. Sachy.

CCG Healthcare's thorough preparation ensured these witnesses provided compelling testimony that painted a clear picture of the reality of chronic pain patients. The husband and wife duo, in particular, gave powerful testimony about their severe pain conditions, countering the government's earlier assertion that it was inappropriate to see patients residing in the same household.

In the face of such compelling defense, the Federal Prosecutors offered a resolution. This led to the dismissal of all charges related to opioid distribution, no jail time, and the return of $1.2 million in assets seized by the Federal Government.

Through the collective efforts of the legal team and CCG Healthcare's extensive investigation and consultation, Dr. Sachy walked out of the Federal Courthouse in Columbus, Georgia, a free man.
